1. General provisions

These terms and conditions apply to the vacation/holiday apartments “Kas Iguana” and “Kas Kadushi” located at Jato Bako 48/48a, Kralendijk, Bonaire, further referred to as “the property”.

The property is intended to be used for recreation purposes only. Tenant may not stay longer than the agreed upon rental period without prior consent of the landlord, property manager or its agents.

The tenant acknowledges that by paying the security deposit, or some amount of the rental charges, he/she has read and agrees to be bound by the general conditions outlined in this document.

2. Reservation and Payments

2a. Security Deposit
A refundable security deposit equal to one third (33%) of the total rent shall be paid within 7 days after receiving your reservation invoice. Your reservation will NOT be considered confirmed until this security deposit has been received. Unless otherwise listed separately, the costs of final cleaning, gas, electricity and tourist tax are included in the rental total.

2b. Balance Due
The balance due must be received no later than 30 days prior to your arrival. A confirmation email will be sent upon receipt of payment. If payment has not been received 30 days prior to arrival and earnest effort has been made to establish contact with the renter, such circumstance will result in the reservation cancellation. At such time the Cancellation Policy, in accordance with Article 3, will be invoked. Any prior deposit will be forfeited and deemed non-refundable. In addition, we subsequently reserve the right to make the apartment(s) available for rental.

2c. Maximum number of occupants
Maximum occupancy of the property is 4 people. If it is determined that a greater number of occupants intend to utilize the property, the landlord, property manager or its agents may deny access to the property to these additional occupants.

2d. Cleaning
It is expected that tenants shall “broom clean” the property prior to vacancy. In addition, all appliances, cooking utensil, pots, pans, cutlery, etc. shall be cleaned and in good working condition upon vacating the premises.

2e. Guarantor
Upon vacancy, the property shall be inspected for damage and inventory. The security deposit will be refunded in cash or into the tenant’s account within 5 business days subject to any withholdings. The cost to repair any damage beyond normal wear and tear, to replace missing household items or to cover any excessive electricity or water use shall be withheld from the security deposit.

2f. Pets
Small pets are allowed.

3. Services
Our apartments include :
* Electricity, water and gas. (with normal use)
* Air conditioning in all bedrooms.
* Cable TV.
* Stereo, radio and DVD player.
* Wireless Internet.
* Microwave
* Kitchen with refrigerator, stove & oven, small appliances and utensils.
* Weekly change of bath and kitchen towels. (Not intended for outdoor use)
* Weekly change of bed linens.
* 220 and 127V, 50Hz electrical outlets.
* Private off-street, lockable parking.
* Pick-up and transfer to the airport.
* Flexible arrival / departure times depending on your flight.
* Outdoor shower and sink for rinsing all diving equipment.

4. Cancellation

4a. Cancellation by the tenant
All cancellations must be made in writing or by email. Cancellations up to 30 days prior to arrival are subject to a forfeiture of the security deposit. Cancellations 7 – 30 days prior to arrival are subject to a 90% cancellation fee. Cancellations less than 7 days prior to arrival are subject to a 100% cancellation fee. No refund will be made in the event of non-occupancy or departing prior to the end of the rental agreement.

4b . Cancellation by landlord
Should unforeseen circumstances arise or force majeure deem a cancellation, the lessee shall be immediately notified and a refund payment shall be made.

5. Responsibilities

5a. Responsibilities of a Landlord
The landlord shall not be held responsible for:
 Any disruption or unavailability of the property during the rental period as a result of unforeseen or insurmountable events beyond our control.
 Discomfort and / or interruption of water or electricity caused by the work of others, such as municipalities, acts of God, etc.
 For any injuries due to damage, negligence or other circumstances that may arise.
 For loss, theft or damage to baggage, personal property or vehicle. It is recommended that prior to occupancy tenant(s) secure travel insurance.

5b. State of the property and inventory.
At time of occupancy, the prooperty will be clean and in good condition. In addition, a full complement of household items will have been made available to tenant. If you find this is not the case, immediately report the discrepancy to our property manager: Peter de Graaf at +599.701.7373. Failure to do so may result in forfeiture of some or all of the security deposit.

6. Complaints and disputes
Despite our best efforts, we understand that things can go wrong. In the event you have a legitimate complaint, please let us know in writing no later than 5 days after your departure. We can be reached via email at bokbonapts@gmail or by visiting our website at www.bokbonapartments.com.
